2. Location Data and Privacy The CupFinders Service relies on your current location to provide accurate cafe listings.

2.1 Location Consent To use the core functionality of the App, you must enable location services on your device and provide explicit consent for the App to access your location data. If you disable location services, the App will not be able to function as intended.

2.2 Use of Location Data We use your location data solely to find and display nearby cafes. We do not track your location when the App is closed, nor do we store persistent user location history. Please refer to our Privacy Policy (linked separately) for a complete description of how we collect, use, and protect your personal and location information.

2.3 Third-Party Map Services The App utilizes third-party map and data services (such as Google Maps or Apple Maps). Your use of those services is subject to
their respective terms of service and privacy policies.

3. License to Use the App

3.1 Grant of License Subject to these Terms, CupFinders grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable license to download and use the App on your mobile device for your personal, non-commercial use.

3.2 Intellectual Property The App, including its design, text, graphics, data models, and all intellectual property rights related to them, is the exclusive property of CupFinders (or its licensors). This agreement does not transfer any right, title, or interest in the App or its content to you.

4. Prohibited Uses You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include, but are not limited to: Tampering: Attempting to probe, scan, test the vulnerability of, or hack the Service or any related system or network. Scraping: Using any automated means (including bots, spiders, or scrapers) to access, copy, or monitor any portion of the App or its data. Reverse Engineering: Attempting to decipher, decompile, disassemble, or reverse engineer any of the software or code comprising or in any way making up a part of the Service. Misuse of Data: Using the cafe or location data provided by the Service for any commercial purpose (such as creating a competing database or service) without express written permission.

5. Disclaimers and Limitation of Liability

5.1 "As Is" Basis THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CUPFINDERS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE INFORMATION, CONTENT, OR MATERIALS INCLUDED IN THE APP.

5.2 Accuracy of Information Cafe and location data, including business hours, addresses, and availability, are derived from third-party sources. CUPFINDERS DOES NOT GUARANTEE THE ACCURACY OR TIMELINESS OF THIS INFORMATION. You are responsible for verifying any information before relying on it (e.g., calling a cafe to confirm hours).

5.3 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CUPFINDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE.

6. Modification and Termination

6.1 Changes to Terms We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms within the App. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

6.2 Termination We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

7.1 Governing Law These Terms shall be governed by the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
